One of three men charged with break-and-enters at Tim Hortons locations throughout Niagara in January had his punishment meted out in court on July 14 and for most Canadians, it could be considered a harsh one.

Kevin Michael Boutilier, 42, of Niagara Falls is now forbidden in any Ontario location of Tim Hortons. That is, once he serves two years in prison first and the three years probation that was also handed down.

It is unknown whether the two men charged with him – one from Pelham, the other from St. Catharines – have faced their court dates yet and even if the charges still stand.

Between January 21 to 29, Niagara Police were investigating several overnight break-ins at Tim locations in Fort Erie, Welland, Niagara Falls, and St. Catharines.

On January 29, a Niagara Police officer spotted three men “acting suspiciously” in their car when the police concentrated on an area in the McLeod Road and Kalar Road area of Niagara Falls.

When he pulled over the car, he realized the three men matched the description of a trio that had broken into a Tim Hortons earlier that evening. There was evidence of that earlier break-and-enter in the car, Niagara Police said at the time.

The police estimated that the take from the various break-ins was more than $14,000.

Boutilier was the one of two in the trio to be charged with possession of property obtained by crime under $5,000, as well as the break-and-enter charges. He was also charged in relation to a break and enter at a Welland Petro Canada where a stolen pick-up truck was used to rip an ATM from the convenience store area.
